Terms of Service (TOS)
Welcome to Otachi. These Terms of Service govern your use of
our platform and services. By accessing or using our platform, you acknowledge and agree to
these terms in full. If you do not agree with any part of these terms, you may not use our
services.
Otachi is an independent, automated crypto escrow
platform designed to facilitate secure transactions between buyers and sellers using
USDT or other supported cryptocurrencies.
- We do not buy, sell, or endorse any products or services.
- We do not provide financial, banking, or money transmission services.
- We do not moderate, investigate, or verify transactions unless a dispute is
raised.
- We are not a party to any contract or agreement between buyers and sellers.
- We do not offer chargebacks, refunds, or reversals after transactions are
finalized.
Our role is strictly limited to holding funds in a custodial
escrow wallet and automatically releasing them based on pre-agreed terms between users.
- When a transaction is initiated, funds are held in a temporary custody wallet
until the buyer confirms receipt of the product or service.
- Our system will automatically deduct escrow fees upfront, as displayed at the
time of transaction creation.
- Once funds are released to the seller, the transaction is considered final and
irreversible.
- We do not intervene in transactions unless a dispute is formally raised by one
of the parties.
- We are not responsible for lost or stolen funds due to user errors (e.g.,
incorrect wallet addresses, unauthorized access to accounts).
- If a user provides an incorrect wallet address, we are not responsible for lost
funds.
- Once funds are released, we have no control over disputes that arise afterward
(e.g., service quality, warranties, or buyer dissatisfaction).
We only intervene in disputes when a formal claim is raised before funds are released.
- Both parties must submit evidence (screenshots, proof of service/product
delivery, communication logs).
- We will evaluate the evidence and make a neutral decision based on what is
verifiable.
- Our decision is final and binding—there is no appeal process.
- We do not guarantee the outcome of any dispute resolution, and users agree to
accept our final verdict without liability to us.
- If insufficient evidence is provided, the transaction may default in favor of
the seller or be returned to the buyer based on available data.
❌ Products/services that fail AFTER funds are released (e.g., warranty issues, disputes
over continued service).
❌ Buyer remorse (e.g., “I changed my mind” or “I found a better deal”).
❌ Fraudulent transactions initiated outside our escrow system (we cannot intervene in
payments made directly).
If users want legal protection beyond our dispute resolution, they must seek legal
action independently. We do not act as a legal authority.
- The quality, legality, or legitimacy of any product or service bought or sold.
- Transactions that involve banned or illegal activities in any jurisdiction.
- Third-party issues, including but not limited to payment processor failures,
blockchain network congestion, or hacking incidents.
- Technical issues, delays, or errors that prevent access to our platform.
- Market volatility affecting cryptocurrency value before withdrawal.
- We do not advertise, promote, or endorse any seller, buyer, or listing.
- We do not accept sponsorships, promotional fees, or commissions from sellers.
- We do not verify the legitimacy of users, businesses, or products listed.
❌ If a user inputs the wrong withdrawal address, the funds CANNOT be recovered.
❌ If a transaction is sent to the wrong recipient, we will not reverse it.
❌ If a user’s wallet is compromised, we are not responsible for unauthorized
withdrawals.
🔹 It is the user’s sole responsibility to safeguard their credentials and verify
payment details.
- We do not provide financial, investment, tax, or legal advice.
- Our platform does not constitute a banking or financial service under any
jurisdiction.
- We do not provide insurance or protection against fraudulent sellers or buyers.
- Users are responsible for ensuring their own compliance with local laws and
regulations.
By using Otachi, you agree NOT to:
❌ Use our platform for money laundering, terrorism financing, or illegal activities.
❌ Attempt to manipulate transactions or commit fraud.
❌ Misrepresent products, services, or dispute claims.
❌ Abuse our dispute system for unfair chargebacks or scams.
🚨 Violating these terms may result in permanent account suspension and fund seizure.
🚨 We do NOT actively monitor, moderate, or investigate transactions.
- We do not inspect listings, verify legitimacy, or conduct background checks on
users.
- We only review transactions when a dispute is raised with verifiable
evidence.
This agreement shall be governed by the laws of [Jurisdiction]. Users agree that all
disputes shall be resolved via arbitration in [Chosen Offshore Location], and any legal
action against us must be filed in this jurisdiction only.
🚨 By using our platform, users waive their right to file legal claims against Otachi
outside of this agreed arbitration process.
We reserve the right to update or modify these terms at any time. Continued use of our
platform after changes means users accept the new terms.
